Vendor Terms
The agreement for food trucks, trailers, carts and pop-up kitchens that sell on BiteHopper. It works alongside the Terms of Use.
Effective November 1, 2026. Last updated October 19, 2026.
These terms are an agreement between iProMentor LLC, which operates BiteHopper, and the business that signs up to sell on BiteHopper (“you” or the “vendor”). You accept these terms by tapping I agree on the vendor agreement in the BiteHopper vendor app or web dashboard. We keep a record of the version you accepted. The person who signs up confirms they are authorized to bind the business.
What you authorize
- You authorize BiteHopper to arrange pickup orders for your business through the BiteHopper apps and website and to collect payment for them through your own Stripe or Square account.
Eligibility
- You are a business operating legally in a BiteHopper market, with the licenses, permits, health inspections and insurance your city, county and state require. You keep them current, and you upload them when we ask.
- We review every application and may decline or remove a vendor at our discretion.
What BiteHopper provides
A storefront page, live location and hours, menu tools, order taking through the vendor app, order updates to customers, and reports on the web dashboard. There is no subscription or monthly fee.
Commission
- You pay a commission on each order placed through BiteHopper. Your commission rate is stated in your vendor agreement, which you accept in the vendor app or web dashboard before you take orders. It also shows on every order ticket.
- Commission is a percentage of the order’s item subtotal after any discount you fund. It is never charged on sales tax or tips. Tips go entirely to you.
- Each order keeps the rate in effect when it was placed. If your rate goes up, we’ll give you at least 30 days’ notice and ask you to accept the new rate before it applies. If you don’t accept, you can keep using BiteHopper’s other features, but new orders pause until you accept or leave.
- Commission is collected as an application fee from each payment, at the moment the payment is captured. You never receive an invoice for it.
Payments
- You connect your own Stripe or Square account. You are the seller and the merchant of record, and customers pay you directly through that account. BiteHopper never holds your money.
- Your payment provider’s own terms apply, and it sets its card fees and payout schedule. Card fees are separate from our commission.
- At checkout the customer’s card is authorized. It is charged when you accept the order. If you don’t accept within 5 minutes, the order is canceled, the hold is released, and nothing is charged or owed.
Orders and fulfillment
- Keep your menu, prices, hours, location and sold-out items accurate, and include allergen information where you can.
- Prepare accepted orders safely, as described and on time, and hand them to the right customer.
- If you can’t complete an accepted order, refund it in the app and tell the customer through BiteHopper.
Refunds
You may refund all or part of an order. BiteHopper support may also issue refunds when an order was missing, wrong or not prepared. When an order is refunded, we return our commission in proportion to the amount refunded. Your payment provider’s card fee is usually not returned. Repeated problems may lead to a review of your account.
- Refund BiteHopper orders in the BiteHopper app or dashboard, not in your Stripe or Square dashboard, so your statements, commission and the customer’s receipt stay right.
Sales tax
BiteHopper calculates sales tax on each order, based on where you are when the order is placed, and adds it at checkout. Unless the law makes BiteHopper responsible for collecting and paying the tax in your state, you remain responsible for reporting and paying sales tax on your sales. We will tell you in advance if that changes in your state. You are also responsible for your own income taxes.
Promotions and loyalty
Offers and discounts you create are funded by you. Promotions paid for by other businesses are funded by those businesses, and the discount is paid back to you as described in the promotion. Some promotions are available only to vendors using certain payment providers. Loyalty stamps you turn on are your offer to your customers.
Customer information
You receive only the customer details you need to complete an order. Use them only for that order. Don’t copy them, contact customers outside BiteHopper for marketing, or share them, unless the customer gives you their details directly.
Your content
You keep ownership of your name, logo, photos and menus. You give BiteHopper a non-exclusive, royalty-free license to display and adapt them to run and promote BiteHopper, including on social media and in marketing, while you are a vendor and for a reasonable time after. You confirm you have the rights to everything you upload.
Independent business
You are an independent business. Nothing in these terms makes you a BiteHopper employee, partner, franchisee or agent. You control how you run your business, including your hours, menu and prices.
Suspension and ending these terms
You can stop selling on BiteHopper at any time from the dashboard or by emailing hello@bitehopper.com. We may suspend or remove a vendor that breaks these terms, puts customers at risk or lets required permits lapse. Orders already accepted must still be completed or refunded, and commission on completed orders remains due.
Liability and indemnity
You are responsible for the food you sell and for your staff. If a claim arises from your food, your operations or your breach of these terms, you agree to defend and cover BiteHopper for it. To the fullest extent the law allows, BiteHopper is not liable for indirect or consequential damages or lost profits, and our total liability to you is limited to the commission you paid us in the three months before the claim.
Governing law and changes
These terms are governed by the laws of the State of Kansas. We may update these terms and will give you at least 30 days’ notice of important changes by email or in the vendor app.
